REPORTER: ALLEGED ABUSE RICHARD LORMAN CUT HIMSELF AND DIED AFTER SHOOTING THE 33-YEAR-OLD WOMAN ON NOVEMBER 15. DAN BULLY. CIRCUIT COURT JUDGE POLLY HALL DISMISSED THE PROTECTION ORDER, IN WRITING, THE COURT CANNOT FIND A CREDIBLE PRESENT THREAT TO THE PLAINTIFF’S SAFETY. THE WOMAN WAS ATTACKED WITH A HEAD 26 DAYS LATER. THE JUDICIARY PAYS OFF FOR A LONG TIME. SHE FOUND THAT JUDGE POLLY HALL CONDUCTED THE HEARING IN ACCORDANCE WITH ALL APPLICABLE LAWS AND PROTOCOLS. THE REPORT GOES A LOT TO HIGHLIGHT THE DIFFERENCE BETWEEN INTIMATE PARENTAL ABUSE, THAT IT CLEARLY INDICATE THIS VICTIM SUFFERED COMPARED WITH THE VY ERNARROW DEFINITION OF CURRENT CREDIBLE THREAT THAT MUST BE APPLIED WHEN ASSESSING A CLAIM FOR PROTECTION ORDER. JUDGE POLLY HALL USED SUEMPRE COURT PRECEDENCE AND ALSO INDICATED SHE CANNOT DETERMINE RECENT PHYSICAL ABUSE IN THE RELATIONSHIP AS EVIDENCE FROM 2016 HAS BEEN INTRODUCED BUT NOTHING MORE RECENT. THE COMMITTEE FOUND THAT THE JUDGE OFFERED SUFFICIENT TIME TO HEAR THE VICTIM’S CASE AND MADE ARRANGEMENTS IN THE COURT TO MAKE IT MORE COMFORTABLE. THE WOMAN WAS NOT REPRESENTED BY A LAWYER. THE DEFENDANT DOES NOT APPEAR AT THE HEARING. THE JUDGE HAS CHOSEN TO CONTINUE WITH THE HEARING AND ISSUE A DECISION ON THE SAME DAY WHICH IS CONSIDERED BY THE COURT SYSTEM AS IDEAL IN THESE SENSIVETI CASES. THE COMMITTEE HAS A NUMBER OF RECOMMENDATIONS TO IMPROVE THIS PROCESS FOR THOSE WHO SEEK PROTECTION AND FOR THE COURT’S RESPONSE.
